I, the undersigned renter, acknowledge and understand that operating or riding in a golf cart involves certain inherent risks, hazards, and dangers that can result in injury, death, or property damage. These risks include, but are not limited to:

• Loss of control, collisions, tipping, or rollover
• Terrain hazards or weather-related dangers
• Mechanical failure
• Improper use by myself or others
• Actions of other drivers, pedestrians, or third parties
   

I voluntarily accept full responsibility for the risk of injury or death while operating or riding in a golf cart rented from Sun and Sea Cart Company.

I agree that I am fully responsible for any damage, loss, theft, or destruction of the golf cart or any additional equipment rented to me. I will be charged for all repair or replacement costs as determined by Sun and Sea Cart Company. This includes:

• Accidental or intentional damage
• Misuse or reckless operation
• Loss of keys or accessories 
• Towing or recovery fees if applicable
   

I certify that:

• I am at least 21 years old and hold a valid driver’s license.
• I will not operate the golf cart under the influence of alcohol, drugs, or any impairing substance.
• I will comply with all applicable laws, regulations, and golf cart use rules.
• I will not allow any unlicensed or unauthorized individual to operate the cart.
• I will only use the cart in designated or permitted areas.
   

In consideration of being permitted to rent and operate a golf cart from Sun and Sea Cart Company, I agree to release, waive, discharge, and hold harmless the company, its owners, employees, agents, insurers, and affiliates from any and all liability, claims, demands, actions, or causes of action related to injury, death, property damage, or loss arising from or related to my rental or use of the golf cart.

This release applies to any cause of action, including negligence, breach of contract, and any other legal theory.

I agree to indemnify and hold harmless Sun and Sea Cart Company against any and all claims, damages, suits, penalties, or liabilities (including attorney's fees) arising from my actions or omissions during the rental period.

I acknowledge that:

• The rental does not include personal injury or liability insurance unless otherwise states.
• I am responsible for all coverage of myself and any passengers.
   

If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
