GOLF CART RENTAL RULES, REQUIREMENTS & POLICIES
Rental Eligibility & General Use:
- Renter must be 21 years or older with a valid driver’s license.
- Only licensed drivers may operate the golf cart.
- Golf carts are street-legal and must obey all Texas traffic laws.
- Maximum occupancy: 4 persons per cart – no exceptions.
- No driving under the influence of alcohol, drugs, or impairing medications.
- All waivers must be read and signed
Rental Terms:
- A valid credit card is required for booking and security deposit.
- All carts must be returned by the agreed rental end time to avoid additional charges.
- Late returns will incur a fee of $25 per 15 minutes unless prior arrangements have been made.
- Carts must be returned in clean condition and free of trash.

Damage & Liability:
- Renters are financially responsible for any damages incurred during the rental period.
- A full inspection will be conducted upon return. Failure to report damage may result in additional charges.
- The rental company is not responsible for any personal injury or loss of property during the use of the cart.
Golf Cart Regulations:
- Carts may not be used after dark unless properly equipped and permitted.
- Golf carts are NOT allowed in the water at any time.
- Do not drive the cart into soft sand, dunes, or off-road areas.
- Stay on designated paths and beach-accessible routes only.
- Keep carts off all environmentally protected areas.
- In addition to the policies stated above, the following is a summary of Local, State, and Federal regulations subject to fines and penalties related to beaches within the city limits of the Village of Surfside Beach: Surfside Beach Rules
Cancellations & Refunds:
- Cancellations made 48 hours or more before rental start time will receive a full refund.
- Cancellations made within 48 hours are subject to a 50% fee.
- No refunds for early returns or inclement weather unless deemed unsafe by local authorities.
- Mechanical Issues: Refund for remaining reservation time.

GOLF CART RENTAL WAIVER
Acknowledgement of Risk:
I, the undersigned renter, acknowledge and understand that operating or riding in a golf cart involves certain inherent risks, hazards, and dangers that can result in injury, death, or property damage. These risks include, but are not limited to:
- Loss of control, collisions, tipping, or rollover
- Terrain hazards or weather-related dangers
- Mechanical failure
- Improper use by myself or others
- Actions of other drivers, pedestrians, or third parties
I voluntarily accept full responsibility for the risk of injury or death while operating or riding in a golf cart rented from Sun and Sea Cart Company.
Responsibility for Damages and Losses:
I agree that I am fully responsible for any damage, loss, theft, or destruction of the golf cart or any additional equipment rented to me. I will be charged for all repair or replacement costs as determined by Sun and Sea Cart Company. This includes:
- Accidental or intentional damage
- Misuse or reckless operation
- Loss of keys or accessories
- Towing or recovery fees if applicable
Acknowledgement of Risk:
I certify that:
- I am at least 21 years old and hold a valid driver’s license.
- I will not operate the golf cart under the influence of alcohol, drugs, or any impairing substance.
- I will comply with all applicable laws, regulations, and golf cart use rules.
- I will not allow any unlicensed or unauthorized individual to operate the cart.
- I will only use the cart in designated or permitted areas.
Waiver and Release of Liability:
In consideration of being permitted to rent and operate a golf cart from Sun and Sea Cart Company, I agree to release, waive, discharge, and hold harmless the company, its owners, employees, agents, insurers, and affiliates from any and all liability, claims, demands, actions, or causes of action related to injury, death, property damage, or loss arising from or related to my rental or use of the golf cart.
This release applies to any cause of action, including negligence, breach of contract, and any other legal theory.
Indemnification:
I agree to indemnify and hold harmless Sun and Sea Cart Company against any and all claims, damages, suits, penalties, or liabilities (including attorney's fees) arising from my actions or omissions during the rental period.
Insurance Acknowledgement:
I acknowledge that:
- The rental does not include personal injury or liability insurance unless otherwise states.
- I am responsible for all coverage of myself and any passengers.
Severability:
If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
